• Helping you understand the business funding you may qualify for
• Funding consultations
• Reviewing your application and funding it through our lending syndicate
• Ongoing support through your funding

By submitting an application, you authorize us to obtain credit and business information for the purpose of identifying the funding you may qualify for. Approval, funding amount, timing, rates, and all other terms are set in your written offer. Outcomes are not guaranteed.

5. Lending and Funding

Biz Capital Partners operates as a private lending syndicate. Funding is provided by the lenders in our syndicate. All funding terms, including amount, rate, fees, and repayment, are presented to you in a written offer before you accept. No funding is provided unless you accept an offer.

6. No Guarantee of Outcomes

We do not guarantee any specific outcome, approval, funding amount, or timing. Past results do not guarantee future outcomes for any individual business.

7. Fees

We do not charge application fees. Any interest, fees, or costs on funding you accept are disclosed to you in your written offer before you accept it.

8. Your Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Not misrepresent your business, financial position, or identity
• Use the Services only for lawful purposes
• Not attempt to access systems or data outside your authorized scope

9. Intellectual Property

All content on the Services, including text, graphics, logos, trademarks, and software, is owned by Biz Capital Partners or licensed to it, and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written permission.

10. Funding and Your Agreement

Funding is provided by the lenders in our syndicate. The written funding agreement you accept governs the terms of your funding, including amount, rate, fees, and repayment. We are not responsible for any product, service, or practice outside the funding we provide to you.

11. SMS Communications

By providing your phone number and affirmatively opting in to SMS through our contact form or chat widget, you consent to receive SMS messages from Biz Capital Partners related to your engagement with us. 12. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZ CAPITAL PARTNERS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED $100.

14. Indemnification

You agree to indemnify and hold harmless Biz Capital Partners and our officers, employees, and affiliates from any claims arising from your misuse of the Services, your violation of these Terms, or your violation of any third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court.

16. Changes

We may modify these Terms at any time. Material changes will be communicated via email or notice on the Services. Continued use after changes constitutes acceptance.
